Welcome to Luxen Red Light Therapy ("Luxen," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of luxenredlight.com (the "Site") and any purchase made through it. By accessing or using our Site, you agree to be bound by these Terms.

2. Eligibility

To purchase from our Site you must be at least 18 years old, provide accurate and complete information at checkout, and have the legal capacity to enter into a binding contract. We reserve the right to refuse service, cancel orders, or close accounts at our discretion.

3. Products and Pricing

  • Product descriptions, images, and prices are provided in good faith but may contain errors, and we may correct them at any time without notice.
  • Prices are shown in US dollars.
  • We may change prices, run promotions, or discontinue products at any time.
  • If an item is unavailable after you order, we will notify you and issue a full refund.

Regulatory status varies by product. Where a Luxen product page states that the device is FDA-cleared, that clearance was granted under Section 510(k) of the Federal Food, Drug, and Cosmetic Act and applies only to the specific indications stated in that clearance. FDA clearance is not an FDA endorsement of the product, and it does not extend to any other Luxen product or to any use outside the cleared indications.

All other Luxen products, including accessories, topical and skincare products, and any device not identified as FDA-cleared on its product page, are general wellness products. They have not been evaluated or cleared by the FDA and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Information on our Site is provided for educational purposes only and is not medical advice. Always consult a qualified healthcare professional before beginning any new wellness routine, particularly if you:

You agree not to use the Site for any unlawful or fraudulent purpose, attempt to gain unauthorized access to our systems, distribute malicious code, harass or defame our staff or customers, post false or misleading reviews, or resell our products without authorization.

Automated access by search engine and AI assistant crawlers that respect our robots.txt file is permitted. Other bulk scraping or data extraction requires our written permission.

10. User-Generated Content

If you submit reviews, photos, or other content, you grant Luxen a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for marketing and business purposes. You confirm the content is your own, accurate, and does not violate anyone else's rights. We may moderate or remove content at our discretion.

11. Disclaimers

Except as expressly stated in these Terms or in a written product warranty, the Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. We do not guarantee that the Site will be uninterrupted or error free. Nothing in these Terms limits any warranty or right you have under applicable law that cannot be waived.

12. Limitation of Liability

To the maximum extent permitted by law, Luxen and its affiliates, officers, employees, and partners are not liable for indirect, incidental, special, or consequential damages, lost profits, lost data, or damages exceeding the amount you paid for the product in question. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.

You agree to indemnify and hold harmless Luxen and its affiliates from claims, damages, losses, or expenses, including legal fees, arising from your use of the Site or products, your violation of these Terms, or your infringement of third-party rights.

If that does not resolve the matter, disputes will be brought in the state or federal courts located in Pinellas County, Florida. Nothing here prevents either party from bringing a claim in small claims court.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, form the entire agreement between you and Luxen regarding the Site and our products.
